The director of a Leicester-based construction company was handed a suspended prison sentence after pleading guilty to breaching section 37 of the HSWA, relating to an underlying breach of section 3(1) by his business at Leicester Magistrates’ Court.
The prosecution relates to an employee who was working on a house extension, While undertaking roof construction on 18 March 2019, the 59-year-old fell just under eight feet while walking on the beams and died in hospital on 13 May as a result of his injuries.
The HSE investigation found the company’s director had failed to manage the roof work including that done by the subcontractors; although the employee had accessed the beams via a ladder, there was no edge protection in place to prevent him falling.
The director received a 20-week prison sentence, suspended for two years and was also ordered to complete 200 hours of unpaid work. He also must also pay £10,000 in costs.
